Términos del servicio

Este documento está disponible sólo en inglés, que es la versión que rige.

Last updated: September 28, 2026

These Terms of Service ("Terms") govern your use of the website at https://tramify.com (the "Website") and the Tramify platform and related services (together, the "Service"), provided by Tramify LLC, a Florida limited liability company ("Tramify", "we" or "us"). "You" means the business that creates an account or subscribes to the Service, and "Authorized Users" means the individuals you allow to use it under your account.

1. Acceptance

By creating an account, starting a free trial, subscribing or otherwise using the Service, you agree to these Terms on behalf of your business. If you do not agree, do not use the Service. Our Acceptable Use Policy, Cancellation Policy, Refund Policy and Legal Disclaimer form part of these Terms, and our Privacy Policy explains how we handle personal data. A separate written agreement signed with Tramify prevails over these Terms where they conflict.

2. Eligibility

The Service is built for businesses and is not intended for personal or household use. You must be at least 18 years old, act on behalf of a business or other organization, and have authority to bind it to these Terms. The Service is not directed to children under 18, and every Authorized User must also be at least 18.

3. Accounts and Security

You must keep your registration and billing information accurate and up to date. You are responsible for all activity under your account, for assigning roles and permissions to your Authorized Users, for keeping credentials confidential, and for notifying support@tramify.com promptly of any unauthorized access.

We protect the Service with HTTPS/TLS for all connections, role-based access, controlled user permissions, audit logs of access and changes, and logical separation of each customer's data, with dedicated databases on higher plans. No system can guarantee absolute security.

4. The Service and Early-Access Features

Tramify is a subscription-based business-management platform for service-based businesses. Depending on your plan, it may include CRM and pipelines, workflow automation, customer communications (such as WhatsApp and Instagram through Meta's business APIs), forms and documents, appointments and tasks, and AI-assisted productivity.

Several capabilities are in early access and roll out in stages. Early-access features may be incomplete and may change or be discontinued. Descriptions on our website of functionality that is not yet available in your account are not commitments: we do not promise to deliver any future feature by a particular date, and your purchase is not contingent on it.

We may modify the Service from time to time, but we will not materially reduce the core functionality of your plan during a billing period you have already paid for, unless required by law, for security reasons, or because a third-party provider changes or discontinues its service.

5. Free Trial

We may offer eligible customers a free trial. When we do, its length and conditions are shown before the trial starts, and we may limit free trials to one per business. If you provide a payment method, the subscription you selected begins automatically at the end of the trial and you are charged the applicable fee, unless you cancel before the trial expires. The applicable price and billing frequency are displayed before you confirm your subscription. Without a payment method, access ends when the trial expires unless you subscribe.

6. Subscriptions, Fees and Taxes

  • Plans. Plans are billed monthly, in advance, in U.S. dollars. As of the date of these Terms, plans include Starter ($29 USD/month), Growth ($99 USD/month) and Scale ($199 USD/month). Current prices are shown on the Website and before you confirm a subscription.
  • Automatic renewal. Your subscription renews automatically each month until you cancel, and you authorize us to charge your payment method for each renewal at your plan's then-current price.
  • Usage-based charges. Some features may carry usage-based charges, such as messaging, AI or usage credits. Where they apply, they are calculated separately from your subscription fee.
  • Taxes. Fees exclude taxes. Applicable taxes are calculated separately and are your responsibility.
  • Payments. Payments are processed by our third-party payment processor, Stripe. Tramify does not store full card numbers. If a payment fails, we may retry it and suspend the Service while the amount remains unpaid.
  • Price changes. A new price applies to an existing subscription only from a later billing period, and we will notify you in advance so you can cancel first.

7. Cancellation

You may cancel at any time. Cancellation takes effect at the end of your current paid billing period, and you keep access until then. See our Cancellation Policy for details.

8. Refunds

Subscription fees are generally non-refundable once a billing period begins, except where required by law or expressly stated in our Refund Policy (for example, duplicate charges or billing errors reported within 30 days).

9. Customer Data

"Customer Data" means data that you or your Authorized Users submit to the Service or that the Service collects on your behalf, including personal data of your own clients ("End Clients").

You own Customer Data. You grant Tramify a limited license to host, process and transmit it only as needed to provide, secure and support the Service, to comply with law, and as you instruct. For Customer Data, Tramify acts as a service provider or processor on your instructions, which are set out in these Terms and in how you configure the Service. For account, billing, Website and contact-form data, Tramify is the controller, as described in our Privacy Policy, which also explains where data is hosted and transferred. To request data processing terms required by applicable law, write to legal@tramify.com.

You are responsible for Customer Data and for how you collect and use it. In particular, you must:

  • have a lawful basis and all rights needed to collect Customer Data and have it processed through the Service;
  • give End Clients the notices required by law, including notice of your use of service providers such as Tramify;
  • obtain and record any consent required by law or platform rules before contacting End Clients, including opt-in consent for WhatsApp, Instagram or other messaging, and honor opt-outs promptly; and
  • comply with the privacy, data protection and marketing laws that apply to your business.

End Clients should contact you first about their personal data. If they contact us, we may refer them to you and will assist you as reasonably required. When your account ends, we delete or return Customer Data according to your instructions and these Terms, except where the law requires retention; audit logs and signed documents may be kept longer where required by law or by your configuration.

10. Acceptable Use

You must use the Service lawfully and in line with our Acceptable Use Policy. You must not send spam or messages that breach Meta's policies or messaging laws; deceive, defraud or impersonate anyone, including a government agency; attempt unauthorized access to the Service or other customers' data; interfere with the Service or test its vulnerability without our written permission; reverse engineer or copy the Service, except as permitted by law; or resell it without our prior written authorization.

11. Third-Party Services

The Service relies on third parties, including Meta (WhatsApp Business and Instagram), Stripe (payments) and AI model providers such as Google Gemini and OpenAI. When you use a third-party service through Tramify, you must also comply with that provider's terms and policies, including Meta's terms and policies for WhatsApp Business and Instagram. Providers may charge their own fees, restrict accounts, or change or discontinue their services; Tramify is not responsible for their actions, makes no warranty about them, and may modify or discontinue related functionality when they change.

12. AI Features

AI-assisted features help you draft, summarize or organize information. To generate an output, the relevant content, which may include Customer Data, is sent to an AI model provider. AI outputs are generated automatically and may be inaccurate, incomplete or unsuitable. You are responsible for reviewing them before relying on them, sending them to End Clients or using them in decisions, and you should not rely on them alone for decisions with legal or similarly significant effects on individuals. AI outputs are not professional advice.

13. Intellectual Property

Tramify and its licensors own the Service, including its software, design, templates, documentation and trademarks. Subject to these Terms and payment of fees, we grant you a limited, non-exclusive, non-transferable right, during your subscription, for your Authorized Users to use the Service for your internal business purposes. Customer Data remains yours. We may use any feedback you give us without obligation to you.

14. Confidentiality

Each party will use the other's non-public information that is marked or reasonably understood as confidential, including Customer Data, only for the purposes of these Terms, will protect it with at least reasonable care, and will share it only with personnel and service providers who need it and are bound by similar obligations. This does not apply to information that is public through no fault of the recipient, already known to it, independently developed, or lawfully received from a third party, nor to disclosures required by law.

15. No Professional Advice

Tramify is a software provider. Tramify is not a law firm, immigration consultant, tax firm, certified public accountant (CPA) or government agency, and does not provide legal, financial, tax or immigration advice. Templates, workflows, forms and AI outputs are tools, not advice, and Tramify does not guarantee the outcome of any application or case. Customers that are visa-service agencies or other professional service providers remain solely responsible for the services, information and advice they provide to their clients and for their own regulatory obligations. See our Legal Disclaimer.

16. Suspension and Termination

We may suspend all or part of the Service, with notice where practicable, if payment is overdue, if you or your Authorized Users breach these Terms or the Acceptable Use Policy, if your use poses a security or legal risk to Tramify, other customers or third parties, or if required by law or by a provider such as Meta. We will restore access once the cause is resolved.

We may terminate your account if a material breach is not cured within 15 days after notice, immediately for serious or repeated violations, or where required by law. You may terminate by cancelling your subscription. On termination, amounts already due remain payable, Section 9 governs Customer Data, and Sections 9 and 13 to 20 survive.

17. Disclaimers

To the maximum extent permitted by law, the Service, including early-access and AI features, is provided "as is" and "as available", and Tramify disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or completely secure, or that it will satisfy the legal or regulatory requirements of your business.

18. Limitation of Liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Each party's total liability relating to these Terms or the Service will not exceed the amounts paid and payable by you to Tramify in the 12 months before the event giving rise to the claim. These limits do not apply to your payment or indemnification obligations, your breach of Section 10, or liability that cannot be limited by law.

19. Indemnification

You will defend, indemnify and hold harmless Tramify and its members, managers and employees from third-party and regulatory claims, and related damages, fines and reasonable attorneys' fees, arising from Customer Data (including any lack of lawful basis, notice or consent), messages sent through your account, the services you provide to your clients, or a breach of these Terms or of law by you or your Authorized Users. We will notify you promptly, let you control the defense, and cooperate at your expense; you may not settle a claim that imposes obligations on Tramify without our consent.

20. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Unless otherwise required by law, disputes arising out of or relating to these Terms or the Service will be brought exclusively in the courts located in Orange County, Florida, and each party consents to their jurisdiction.

21. Changes to These Terms

We may update these Terms. We will post the new version on the Website with a new "Last updated" date and give reasonable advance notice of material changes by email or in the Service. Continued use after changes take effect means you accept them; if you do not agree, you may cancel before they take effect.

22. General

These Terms, with the policies they refer to, are the entire agreement between you and Tramify regarding the Service, subject to Section 1. If a provision is unenforceable, the rest remains in effect, and not enforcing a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control, except payment obligations.
